Vendor / Seller Agreement

Welcome to YourMarket Online Community! YourMarket is a marketplace where you can sell the items you’ve made, designed, and handpicked, or sourced, directly to buyers around the world. We want to make sure that you and your buyers have a positive experience on YourMarket. Please read on to find out more about your rights, as well as what is expected of you, as a seller.

By opening a YourMarket shop, you’re agreeing to this policy and our Terms & Conditions. By registering as a vendor on YourMarket (“the Platform”), you agree to the following terms:

1. Eligibility

  • You must be 18 years or older.
  • You may only sell home-grown, homemade, handmade, artisanal, or thoughtfully curated goods—no mass-produced, imported, or resale items.
  • Your store must have at least one approved product before it can go live.

2. Vendor Approval Process

  • YourMarket values quality, authenticity, and trust. That’s why we review each new store before it goes live.
  • Here’s how it works:
    • Open Your Store: Register and create your vendor account.
      Build Your Storefront: Upload branding, product listings, shipping info, and store policies.
    • Submit for Review: Once your store is ready, submit it for approval.
    • Internal Review: YourMarket’s onboarding team will review:
      • Product originality (must meet our Creativity Standards)
      • Compliance with Prohibited Item rules
      • Appropriateness of product categories and descriptions
        Store branding and policy clarity
    • Approval or Feedback:
      If everything meets the requirements, your store will be activated and made visible to buyers.
      • If not, we’ll provide feedback and request necessary changes.
    • Re-Submission: You can resubmit for review once updates are made.
  • This process helps maintain a trusted, local-first community built on quality and fairness.

3. Product Standards

  • Products must be made, grown, or curated by you, transparently disclosed in listings.
  • Use original photos and descriptions—no stock images or misleading content .
  • Prohibited items include illegal, restricted, hazardous, offensive, counterfeit, or mass-produced goods.

4. Seller Responsibilities

You agree to:

  • Provide accurate product info, images, and availability.
  • Price items fairly and update stock levels promptly.
  • Ship orders per specified timelines and provide tracking information.
  • Respond promptly and professionally to customer messages and resolve disputes amicably.
  • Maintain your own policies and terms and conditions for shipping, refunds, returns, and cancellations— communicate clearly in each listing.
  • Comply with all relevant South African laws, including tax obligations.
  • Protect buyer privacy and any personal data you receive.

5. Payments, Fees & Withdrawal

  • Payments are managed via TradeSafe escrow; offering VISA, MAstercard, Ozow, Snapscan payment options.
  • You’re responsible for providing and maintaining accurate banking details.
  • TradeSafe reserves the right to hold or return funds if a dispute is opened or platform policies are violated (e.g., non-delivery, misrepresentation).
  • Payments:
    • YourMarket does not directly handle transactions.
    • Fees include:
      • No listing fees
      • Marketplace commission (e.g., ~12% per sale)*
      • TradeSafe processing fee (2.5%–3.5%), paid by buyers
      • Additional charges (e.g., delivery) are borne by buyers.
      • *Commissions and fees subject to market related adjustments
  • Disbursement Timing:
  • Funds are released once the buyer confirms delivery or after the confirmation window closes with no dispute.
  • You are notified via email when funds are available.
  • Withdrawal Process:
  • When creating your Store, select the frequency for withdrawals
  • Each withdrawal transaction is subject to TradeSafe transaction fees
  • Process:
    • Log in to your vendor/seller dashboard.
    • Navigate to Withdraw.
    • Click “Request Withdrawal” to transfer your available balance to your registered bank account via EFT.
    • Allow 3-5 business days for funds to reach your account.

6. Intellectual Property & Content Licensing

  • You retain ownership of your creations.
  • By uploading, you grant YourMarket a worldwide, royalty-free license to display, promote, and share your content on the platform.
  • You must not infringe on others’ trademarks, copyrights, or intellectual property.

7. Performance & Conduct Standards

  • Ship orders within your stated processing times and maintain high service standards .
  • Keep a professional tone in all communications.
  • Do not create duplicate stores, manipulate clicks or search results, or coordinate pricing with other YourMarket sellers.
  • You are responsible for your account — keep passwords secure and update store info promptly .

8. Refunds, Returns & Cases

  • Set and clearly display your own policy for refunds and exchanges.
  • Respond to buyer requests within 48 hours.
  • If you and the buyer cannot resolve a case, YourMarket may intervene to mediate.
  • Refund obligations include non-delivery, misdescription, or damaged items.

9. Account Suspension

YourMarket reserves the right to suspend or remove your store if you:

  • Violate this Agreement or Platform policies
  • Engage in dishonest or illegal activity
  • Receive repeated violations, complaints, or low service performance

10. Limitations of Liability

  • YourMarket is not liable for any indirect losses you may suffer, and our liability per transaction is limited to the commission paid.
  • You agree to indemnify the Platform against IP infringement claims, misuse of buyer data, or breaches of this Agreement.

11. Dispute Resolution

  • Disputes should first be handled via mediation.
  • If unresolved, disputes will be submitted to arbitration in South Africa under the Arbitration Foundation of Southern Africa guidelines.

12. Agreement Updates

We may update this Agreement to ensure compliance, improve service, or incorporate vendor feedback. You will be notified, and continued use after updates implies your acceptance.
